By placing a deposit, executing a purchase agreement, or taking delivery/pickup of any purebred Simmental livestock (bulls, heifers, or cows) from Weisgerber Brothers Simmental (“Seller”), the purchaser (“Buyer”) agrees to the following Terms of Purchase & Sale.
First-to-Deposit Basis: All livestock sales are conducted on a private treaty, first-to-deposit basis. No animal is reserved or held off the market until the minimum required deposit has been received and confirmed by the Seller.
Deposit Requirement: A minimum deposit of $500 per animal is required to lock in a reservation.
Price Protection: Once a deposit is confirmed by the Seller, the agreed purchase price is locked and will not be altered, regardless of subsequent market or price adjustments.
General Deposit Policy: Deposits are generally non-refundable. By submitting a deposit, the Buyer agrees to reserve the selected animal and understands that it will be removed from availability to other potential buyers.
Buyer Cancellations: If a Buyer chooses to cancel a reservation for reasons unrelated to the animal’s health, fertility, or availability, the deposit may be forfeited at the discretion of the Seller. Alternatively, the Seller may allow the Buyer to transfer the deposit toward another available animal.
Full Refund Exceptions: A 100% refund of the deposit will be provided to the Buyer if:
The animal fails its pre-sale Breeding Soundness Examination (BSE) / fertility semen test.
The animal sustains a significant injury prior to pickup or delivery.
The animal becomes seriously ill prior to pickup or delivery.
The animal dies before transfer of possession.
The Seller is otherwise unable to fulfill the sale.
Accepted Payment Methods:
Interac E-Transfer (Preferred method)
PayPal (Processed directly via the website)
Cheque (Personal or certified cheque, arranged in advance)
Final Balance Payment: The remaining balance of the total purchase price is due in full at or before the time of farm pickup or livestock delivery.
Pickup Deadline & Boarding Fees:
Unless mutually agreed upon in writing prior to sale, animals must be picked up or scheduled for delivery prior to June 1 of the purchase season.
For animals remaining on the farm past the agreed-upon date, a yardage and daily maintenance fee of $20.00 per day will be charged to cover labour, forage, and care costs.
Breeding Soundness Examination (BSE): Every bull sold undergoes an official Breeding Soundness Examination (semen and physical evaluation) conducted prior to sale.
Vaccination Protocol: All livestock are current on a standard Alberta beef vaccination protocol (including IBR, BVD, PI3, BRSV, and Leptospirosis). Full health and vaccination records are available upon request.
Breeding Guarantee: The Seller stands behind the breeding soundness and physical capability of every bull sold. If a bull is determined to be structurally or genetically incapable of breeding due to conditions that existed prior to the transfer of ownership, the Buyer must notify the Seller immediately.
Depending on the circumstances, the Seller may:
Provide a suitable replacement bull (subject to availability).
Provide credit toward a future purchase.
Work directly with the Buyer to reach a fair and reasonable resolution.
Guarantee Exclusions: This breeding guarantee does not cover:
Physical injury, illness, or accidents occurring after delivery/pickup.
Neglect, improper nutrition, or improper management practices.
Exposure to disease after transfer of ownership.
Natural disasters, lightning, or circumstances beyond reasonable control.
Farm Pickup: Farm pickups take place at the farm located 10 minutes west of Medicine Hat, AB on Hwy #3, by appointment only. The Buyer is responsible for providing a clean, safe, and livestock-appropriate trailer.
Delivery Terms:
Repeat Customers: Complimentary delivery within the standard service area, regardless of distance.
First-Time Buyers (Beyond 100 km): Delivery fees will be quoted for distance beyond 100 km.
Out-of-Area / US Shipping: Long-distance delivery to Saskatchewan, northern Alberta, or the US border is quoted individually upon request.
Transfer of Risk & Ownership:
The Seller remains fully responsible for the health and safety of the animal until delivery is complete or loading is finished.
Ownership and risk of loss transfer to the Buyer the moment the animal is unloaded onto the Buyer’s property or loaded onto the Buyer’s trailer/transport vehicle.
Representation: Expected Progeny Differences (EPDs), birth weights, weaning weights, bloodlines, and temperament notes reflect official breed association records and honest farm observations at the time of sale listing.
Limitation of Liability: Because livestock are live animals subject to environmental factors, Weisgerber Brothers Simmental cannot guarantee future performance once an animal leaves their care. The Seller’s total liability is strictly limited to the original purchase price of the animal and explicitly excludes:
Lost breeding seasons or lost calf crops.
Lost business income or potential profits.
Veterinary expenses or medication costs incurred after transfer.
Additional transportation or hauling costs.
Indirect, special, or consequential damages.
Neither party shall be held liable for failure or delay in completing pickup or delivery resulting from acts of God, severe weather/blizzard conditions, highway closures, government livestock quarantines, disease outbreaks, or transportation disruptions beyond reasonable control. Both parties agree to work together in good faith to reschedule delivery under safe conditions.
